Maryland - Disclose or Disclaim

The State of Maryland requires that in the vast majority of real property transactions, the seller disclose the condition of all systems in the house, or disclaim this knowledge. In recent years, there seems to have been a growing trend by sellers to provide disclaimers. Buyers and sellers alike should remember: neither a disclosure nor a disclaimer is a substitute for the services of a home inspector. There is a belief in some circles that the use of a disclaimer "takes the seller off the hook." Sellers should remember: Maryland law requires the disclosure of any and all latent defects in a property ... regardless of the conditions of the sale or the use of a disclosure or disclaimer.
